Massachusetts Attorney Announces Regulations for Daily Fantasy

On Thursday, Massachusetts Attorney General Maura Healey announced the drafting of a number of consumer protection regulations for the new and rapidly evolving daily fantasy sports industry. These regulations, which will take effect “immediately” upon their filing with the Secretary of State on today, will impose certain requirements on DFS businesses offering contests in the state.

Among other things, there has been an investigation into the potential misuse of non-public data by a major DFS company employee; an inquiry into DFS by the New York Attorney General; a “preliminary” probe by the FBI and U.S. Department of Justice into the business model of DFS; the filing of numerous class actions against major DFS operators; and reports that a federal grand jury was convened in Florida by the U.S. Attorney’s Office to consider potential violations of federal and state law.
